General Terms and Conditions (GTC)

for orders placed in the schwarzfarbweiss online shop

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via the online shop schwarzfarbweiss, operated by:

These GTC apply to consumers within the meaning of § 13 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for purposes that are primarily outside their trade, business, or profession.

2. Conclusion of Contract

The product listings in the online shop do not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the “Buy Now” button, you submit a binding order for the products in your cart.

You will receive an automatic confirmation of receipt by email immediately after placing the order. This confirmation does not yet constitute acceptance of the contract. The purchase contract is concluded only when the shipping confirmation is sent or the goods are delivered.

3. Prices and Shipping Costs

All prices listed in the online shop are final prices in euros.
In accordance with § 19 of the German VAT Act (UStG), no VAT is charged (small business regulation).

In addition to product prices, shipping costs may apply. These will be clearly shown during the order process.

4. Delivery

Delivery is made within Germany and the European Union by the shipping provider selected during checkout, to the address provided with the order.

The usual delivery time is 2–5 business days after payment has been received.
In case of delivery delays, you will be informed immediately.

5. Payment

Payment can be made using the following methods offered in the online shop:

  • PayPal

  • Credit card

  • Apple Pay / Google Pay (if enabled)

  • Bank transfer (upon request)

Payment is due at the time of contract conclusion.

6. Retention of Title

Goods remain the property of Isabella Fischer until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with § 355 BGB.
Details are provided in the separate cancellation policy.

8. Return Shipping Costs

In case of a withdrawal, the customer bears the cost of return shipping, unless the delivered goods are defective or incorrect.
A return label will only be provided in such cases.

9. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • sealed items that are not suitable for return for hygiene reasons (e.g. earrings) once the seal has been removed;

  • customized or personalized items made according to customer specifications.

10. Warranty

The statutory warranty provisions apply (§§ 434 ff. BGB).
In the event of defects, you are entitled to supplementary performance (repair or replacement).
Custom-made items are excluded from exchange unless a defect is present.

11. Liability

We are liable without limitation for intent and gross negligence.
In the case of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), and only for the typical, foreseeable damage.

12. Data Protection

The collection and processing of personal data is carried out in accordance with applicable data protection laws.

13. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

14. Final Provisions

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
